This Privacy Policy explains how Curador Brands ("Curador," "we," "us," or "our") collects, uses, shares, and protects information when you visit curadorbrands.com (the "Site"), interact with our marketing communications, or otherwise engage with our portfolio of cannabis brands (including, without limitation, HeadChange, Safe Bet, Bubbles, and AIRO).

Curador Brands is a Missouri-based cannabis brand house. Our products are manufactured by Missouri-licensed facilities and sold exclusively through licensed Missouri dispensaries. You must be 21 years of age or older to access this Site or to receive any of our marketing communications.

By using the Site or signing up for our communications, you agree to this Privacy Policy and our Terms of Service.

Curador Brands is the brand house behind a portfolio of Missouri-licensed cannabis products. Curador Brands itself is not a Missouri-licensed cannabis facility; product manufacturing, testing, distribution, and retail sales are performed by Missouri-licensed third-party operators in compliance with Article XIV of the Missouri Constitution and the rules of the Missouri Division of Cannabis Regulation ("DCR").

3. Age Requirement (21+)

Our Site, our products, and all of our marketing communications are intended for adults aged 21 or older. We use an age-gate on entry to the Site and at the point of email/SMS signup. If you are under 21, you must exit the Site immediately and you may not subscribe to any of our communications. We do not knowingly collect personal information from anyone under 21 (or under 13, as covered by the federal Children's Online Privacy Protection Act, "COPPA"). If you believe a minor has given us information, please contact us at legal@curadorbrands.com and we will delete it.

5. How We Use Information

We use personal information to:

  1. Operate and improve the Site, including authentication, security, fraud prevention, and analytics.
  2. Verify age before granting access to age-restricted content, products, or marketing programs.
  3. Send the email marketing you have opted into — product news, brand updates, dispensary availability, events, and promotions — in compliance with the federal CAN-SPAM Act.
  4. Send the SMS/MMS messages you have opted into — product drops, event reminders, and promotions — in compliance with the federal Telephone Consumer Protection Act ("TCPA") and CTIA/Mobile Marketing Association ("MMA") guidelines.
  5. Respond to wholesale, retail-partner, media, careers, and general inquiries.
  6. Comply with applicable cannabis advertising rules, including those of the Missouri Division of Cannabis Regulation.
  7. Comply with other legal obligations and respond to lawful requests from public authorities.
  8. Protect our rights and safety and the rights and safety of others.
  9. Conduct corporate transactions such as financings, mergers, and acquisitions, with appropriate confidentiality protections.

We do not use personal information for automated decision-making that produces legal or similarly significant effects on you.


6. Email Marketing — How Consent and Unsubscribes Work

We use a confirmed (double) opt-in process for email marketing that goes beyond the minimum requirements of CAN-SPAM:

  1. You submit your email address through a signup form on the Site, an event, or a partner channel.
  2. We send a confirmation email asking you to verify your subscription.
  3. Only after you click the confirmation link does your address enter our active marketing list.

You can unsubscribe at any time by clicking the link at the bottom of any marketing email, or by emailing legal@curadorbrands.com with the subject "Unsubscribe." Transactional messages (e.g., responses to your inquiries) are not considered marketing and may continue.


7. SMS/MMS Marketing — TCPA-Compliant Mobile Program

By providing your mobile number and separately opting in (e.g., by checking a clearly labeled SMS consent box, by texting a keyword, or by responding "Y" or "YES" to a confirmation message), you give your prior express written consent under the TCPA to receive recurring marketing text messages from Curador Brands and our portfolio brands at the number you provide, sent using an automatic telephone dialing system or pre-recorded voice. Consent to receive marketing messages is not a condition of any purchase.

7.2 Confirmation (Double Opt-In)

We use a confirmed double opt-in process. After you provide your mobile number, you will receive a confirmation message asking you to reply "YES." You will not be enrolled in the program unless and until you confirm.

7.3 No SMS-Specific Information Sharing

We do not sell or rent your mobile number, and we do not share your mobile number with third parties for their independent marketing. Mobile information will not be shared with third parties or affiliates for marketing/promotional purposes. All categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

7.4 Records of Consent

We retain records of your opt-in (date, time, method, IP address where applicable) for the duration of your subscription and for a reasonable period thereafter to demonstrate compliance with the TCPA.


8. Cookies and Similar Technologies

The Site uses cookies, pixels, local storage, and similar technologies, including:

You can control cookies through your browser settings, opt out of Google Analytics via the Google Analytics Opt-Out Add-on, and we respect Global Privacy Control ("GPC") signals where applicable. Blocking strictly necessary cookies may break Site functionality.


9. How We Share Information

We do not sell personal information for money. We share information only as follows:

  1. Service providers acting on our behalf under written contract — hosting, email infrastructure (e.g., Resend), SMS aggregators (e.g., Twilio), customer-data and marketing-automation platforms (e.g., AlpineIQ), analytics, age verification, customer support, security.
  2. Affiliated brands and entities within the Curador Brands portfolio, only for the purposes described in this Policy and consistent with your consent.
  3. Compliance and safety — to comply with law, valid legal process, or governmental requests; to enforce our terms; or to protect rights, property, or safety.
  4. Business transfers — in connection with a merger, acquisition, financing, reorganization, or sale of assets, with appropriate confidentiality protections.
  5. With your consent — for any other purpose disclosed at the time you provide it.

We do not share mobile opt-in information or SMS consent data with any third party for that third party's own marketing.


10. Data Retention

We retain personal information only as long as reasonably necessary for the purposes described in this Policy, including to provide the Site and services, comply with our legal obligations, resolve disputes, enforce our agreements, and maintain accurate records of marketing consent. When information is no longer needed, we will delete or de-identify it.


11. Data Security

We use commercially reasonable administrative, technical, and physical safeguards to protect personal information, including TLS encryption in transit, access controls, and vendor due diligence. No system is perfectly secure; we cannot guarantee the absolute security of information, and you provide it to us at your own risk.


12. Your Choices and Rights

Regardless of where you live, you may:

12.1 California, Virginia, Colorado, Connecticut, and Other State Privacy Rights

If you reside in a U.S. state with a comprehensive consumer privacy law, you may have additional rights, including the rights to know, access, correct, delete, port, and (where applicable) limit use of sensitive personal information, plus the right to opt out of "sale" or "sharing" for cross-context behavioral advertising. We extend these rights to all U.S. residents as a matter of policy. To submit a request, email legal@curadorbrands.com. You may designate an authorized agent to act on your behalf with appropriate verification. We do not "sell" personal information.

12.2 Missouri Residents

Missouri does not currently have a comprehensive consumer privacy statute. Missouri residents nonetheless receive the rights described in Section 12.


13. Children's Privacy (COPPA + 21+)

The Site is not directed to children. No one under 21 may use the Site or receive our communications. We do not knowingly collect personal information from any individual under 21, and we do not knowingly collect any personal information from any individual under 13 in violation of COPPA. If we learn that we have collected such information, we will delete it.


14. Third-Party Sites and Services

The Site may link to third-party sites (such as Missouri-licensed dispensaries that carry our products, social media platforms, or service-provider portals). We do not control those sites and are not responsible for their privacy practices. Review their policies before providing information.


15. International Visitors

The Site is operated from the United States and is intended for U.S. residents. If you access the Site from outside the United States, you understand that your information will be transferred to, processed, and stored in the United States. We do not market our products internationally.


16. Changes to This Policy

We may update this Policy from time to time. The "Last updated" date at the top will reflect the most recent change. Material changes will be highlighted on the Site or in an email notification. Continued use of the Site after the effective date of any update constitutes acceptance.
